tftp was not started from dnsmasq. I went the way to disable tftp from dnsmasq and used the separate tftp-hpa. works great.

now where dnsmasq does not do dhcp, does not do dns ant also not tftp, I think I can safely migrate to my central dhcp and remove dnsmasq.
